Terms of Service
Article 1 – Definitions
In these Terms of Service, the following definitions apply:

Cooling-off Period: The period during which the consumer may exercise the right of withdrawal.

Consumer: A natural person acting for purposes outside their trade, business, or profession who enters into a distance contract.

Entrepreneur: The natural or legal person offering products remotely to consumers.

Distance Contract: A contract concluded between the entrepreneur and the consumer through remote communication.

Right of Withdrawal: The consumer’s right to withdraw from the distance contract within the cooling-off period.

CESOP: The Central Electronic System of Payment Information introduced by the EU for monitoring payment services.

Article 3 – Applicability
These Terms of Service apply to all offers made by the entrepreneur and to all distance contracts concluded between the entrepreneur and the consumer.
Before the contract is concluded, these terms are made available electronically.
Article 4 – The Offer

All offers are non-binding and subject to availability.

The entrepreneur reserves the right to modify or withdraw offers at any time.

Prices listed include applicable taxes unless otherwise stated.

Any additional costs such as shipping fees, customs duties, or courier charges are clearly communicated at checkout.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and completes the checkout process.
The entrepreneur will confirm the agreement by email.
The products sold by Designer Outlet Liverpool are not original designer items.
Our footwear and clothing are inspired by popular styles and are offered at significantly reduced prices.
Article 6 – Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days of receiving the goods, provided that:

Items are unworn, unused, and in original condition

All original packaging, labels, and tags are intact
Return shipping costs are borne by the consumer.
Article 7 – Exclusion of Right of Withdrawal (Sale Items)
Items purchased during sales, promotions, or at a discounted price are final sale and cannot be returned or refunded.
This exclusion applies because discounted items are offered at significantly reduced prices and often involve limited or end-of-line stock, making resale or restocking impractical.
Customers are advised to carefully review product descriptions, sizing information, and images before purchasing discounted items.
Article 8 – Refunds in Case of Withdrawal
If a return is accepted, refunds will be processed within 14 days after receipt and inspection of the returned items, using the original payment method.
Original shipping costs are non-refundable.
Article 9 – Customs, VAT & Import Responsibilities

The customer is solely responsible for complying with all import regulations applicable in the destination country.

This includes payment of import duties, VAT, taxes, and customs clearance fees, if applicable.

Designer Outlet Liverpool does not act as the importer of record.

Any additional fees charged by customs authorities or courier services are the responsibility of the customer.

Failure to comply with import regulations does not constitute grounds for cancellation or refund.
Article 10 – CESOP Compliance
From 2024, payment service providers are required to register transaction data in the CESOP system in accordance with EU regulations.
Designer Outlet Liverpool complies fully with these requirements.
Article 11 – Conformity & Warranty

The entrepreneur ensures that products conform to the agreement and applicable legal requirements.

Any complaints regarding defects must be reported in writing within 14 days of receipt.

Items must be returned in their original condition and packaging.
Article 12 – Delivery

Orders are delivered within 30 days, unless otherwise stated.

In case of delays, the consumer will be informed as soon as reasonably possible.

Once an order has been handed over to the courier, Designer Outlet Liverpool is not responsible for delivery delays caused by the shipping carrier, including but not limited to strikes, weather conditions, customs inspections, or logistical disruptions.

Delays caused by couriers or customs do not entitle the customer to cancellation or refund.
Article 13 – Complaints Procedure

Complaints must be submitted in writing within 7 days of discovering the issue.

The entrepreneur will respond within 14 days of receipt.

If a longer resolution time is required, an estimated timeframe will be provided.
Article 14 – Governing Law & Disputes
These Terms of Service are governed by Dutch law.
Disputes will first be attempted to be resolved amicably. If this is not possible, disputes will be submitted to the competent court.
